Title VI (Non-Discrimination)
Title VI and Environmental Justice stem from the 1964 Civil Rights Act stating that “No person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.” Title VI bars intentional discrimination as well as disparate impact discrimination (i.e., a neutral policy or practice that has a disparate impact on protected groups). Other related rules and acts include Executive Order 12898 regarding environmental justice in minority and low-income populations; Executive Order 13166 regarding access to services for people with limited English proficiency; as well as Title II of the Americans with Disabilities Act (ADA).
